SmoredBoard Terms of Use

From everyone at Smored LLC, thank you for using our software! We built SmoredBoard to enhance your experience and give you the best soundboard we can.

Definitions
When we say "Company", "we", "our", or "us" in this document, we are referring to Smored LLC
When we say "Services", we mean our website (smoredboard.com) and any product created and maintained by Smored LLC, including the SmoredBoard soundboard software, SmoredBoard Pro, and their associated tools.
When we say "You" or "your", we mean the people or organizations that own an account with or use any of our Services.

Acceptance of Terms

By using and installing the SmoredBoard, you are agreeing to these Terms of Use ("Terms"). We may update these Terms from time to time. If we make significant changes, we will update the date at the top of this page and do our best to notify account holders. Continued use of SmoredBoard after changes are published constitutes your acceptance of the revised Terms.

Account Terms

  • You are responsible for maintaining the security of your account and password, and for any activities that occur under your account. Do not share your password with anyone. Our Company will never ask for your password. Sharing your account with anyone else is strictly prohibited, and we reserve the right to revoke access to our Services if account sharing is detected.

  • You may not use the Services for any unlawful purposes or violate any laws while using our Services.

  • You are responsible for all content you post and any activity that occurs under your account.

  • You must be a human. Accounts registered by "bots" or other automated methods are not permitted.

  • You can request your account information to be deleted at any time by contacting support at support@smoredboard.com

SmoredBoard Pro Terms
SmoredBoard Pro is a premium subscription-based service that provides access to additional features and tools. By subscribing to SmoredBoard Pro, you agree to the following:

1. Subscription Plans:
   o    SmoredBoard Pro is available on a [monthly, yearly, or lifetime subscription basis]. Pricing and features may vary by plan.
   o    You are responsible for selecting a plan that meets your needs. Plan details are available on our website.


2. Payments and Renewals:
   o    All subscription payments are processed securely through Stripe.
   o    Subscriptions automatically renew at the end of the billing period unless canceled before the renewal date.
   o    If a payment fails, your account may be downgraded to the free version until payment is resolved.
   o    We reserve the right to modify the pricing of SmoredBoard Pro subscriptions at any time.
   o    If we change the price of your plan, you will be notified at least 14 days in advance via email.
   o    Continued use of SmoredBoard Pro after the effective date of the price change constitutes your acceptance of the new pricing.
   o    Renewals made after the effective date of the price change will automatically reflect the updated pricing.


3. Free Trial:
   o    New users may receive a free trial period for SmoredBoard Pro, as specified on our website. Once the trial expires, payment is required to continue using Pro features.


4. Refund Policy:
   o    Refunds are available for all SmoredBoard Pro purchases, including subscriptions and lifetime licenses, within 48 hours of purchase or renewal. To request a refund, please                   contact our support team at support@smoredboard.com.

   o    Refunds are not available for partially used subscription periods beyond 48 hours, except where required by applicable law.


5.Access and Usage:
   o    SmoredBoard Pro features are licensed to the account holder and may not be shared, resold, or transferred.
   o    Access to Pro features is subject to compliance with these Terms.


6. Modifications:
   o    SmoredBoard reserves the right to modify or discontinue Pro features at any time, with or without notice.


7. Termination:
   o    If your subscription is terminated for any reason, access to Pro features will end at the conclusion of your current billing period.

Uptime, Security, and Privacy

  • Your use of the Services is at your own risk. We provide our Services "as is" and "as available" without any warranties.

  • We take the security of your data seriously and use reasonable efforts to protect it. However, we cannot guarantee absolute security.

  • For details on how we handle your data, please refer to our Privacy Policy, which you can find on our website.

Copyright and Content Ownership

  • You retain ownership of all content you submit to the Services, including any sounds you upload. You retain all copyrights to your content. We do not claim ownership of your content.

  • The Company owns all rights to the Services, including intellectual property rights. You may not duplicate, reverse engineer, or decompile any part of the code or design without our express written permission, except for user profiles. By 'user profiles', we mean the soundboard profile “.json” files that store information such as where your sound effects (SFXs) are stored, images, and other related settings that are necessary for profiles.

Third-Party Integration

  • The only third-party integration currently available is with the Stream Deck. We do not offer an open API for public use.

  • We are not responsible for any third-party integration that you use with our Services.

Liability

  • The Company shall not be liable for any damages, including lost profits or data, resulting from the use of our Services. Your use of our Services is at your own risk.

Governing Law and Jurisdiction These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any legal actions or disputes shall be resolved exclusively in the courts located in Florida.

Smored LLC shall not be held responsible for delays or failures in performance resulting from events beyond our reasonable control, including acts of God, government restrictions, or technical failures.
